Assisted Living Facility Insurance California — Complete Protection

California assisted living facilities and RCFEs care for some of the most vulnerable members of our community — and carry enormous insurance responsibilities. A standard GL policy leaves you dangerously exposed. We build properly structured programs that protect your facility, your staff, and your residents.

Who needs this coverage

California Residential Care Facilities for the Elderly (RCFEs) and assisted living communities face a complex web of insurance requirements driven by CDSS licensing, lender requirements, and the practical realities of caring for elderly residents with cognitive decline, mobility challenges, and chronic conditions. Most assisted living operators we speak with are significantly underinsured.

⚠️ Critical coverage gap most operators have: Standard general liability explicitly excludes abuse and molestation claims — yet this is often the highest liability exposure for care facilities. Most also lack proper professional liability coverage. A free 20-minute policy review reveals exactly where your gaps are.

Coverage Breakdown

Essential coverages for your facility

A properly structured program includes all of these working together — not just a basic GL policy.

🛡️

General Liability Insurance

Covers third-party bodily injury and property damage. Required by most licensing agencies and landlords. Minimum $1M/$2M recommended for care facilities.

📋

Professional Liability (E&O)

Covers claims arising from professional care decisions, medication management, supervision errors, and clinical mistakes. Standard GL explicitly excludes these claims.

👷

Workers' Compensation

Required by California law the moment you hire your first employee. Covers medical costs and lost wages for injured caregiving staff — one of the highest-risk occupations in California.

🏢

Commercial Property Insurance

Covers your facility building, equipment, furnishings, and medical devices against fire, theft, vandalism, and other covered perils.

🚨

Abuse & Molestation Coverage

Explicitly excluded from standard GL. Covers legal defense and settlements for claims of physical, sexual, or emotional abuse by staff or between residents. Essential for any care facility.

🌐

Cyber Liability Insurance

Covers costs from data breaches involving protected health information (PHI). HIPAA violations and patient data breaches are increasing risks for all healthcare-related facilities.

☂️

Umbrella Insurance

Provides an additional layer of liability protection above your GL and professional liability limits. Typically adds $1M–$5M of coverage at very competitive rates.

👔

Directors & Officers (D&O)

Protects board members and executives from personal liability for decisions made in their official capacity. Important for incorporated facilities with a board of directors.

FAQ

Common questions

California doesn't always specify exact dollar amounts, but CDSS expects adequate liability coverage as part of operating standards. More importantly, the practical liability exposures of an assisted living facility — resident falls, medication errors, abuse claims — make proper coverage essential regardless of what's technically required.
Most caregiving staff in assisted living facilities fall under classification 8827 (Home Health Aide/Caregiver) or 8824 (Residential Care). These are higher-risk classifications with rates of $7–$15 per $100 of payroll. Clerical and administrative staff have much lower rates. Correct classification is important — misclassification leads to audit surprises.
Elopement (a resident with dementia leaving without authorization) is one of the most common liability claims in assisted living. Coverage depends on your policy specifics and the supervision protocols you have documented. This falls under both GL (premises liability) and potentially professional liability (supervision decisions). We review both in our consultation.
Pricing depends on resident count, staffing levels, services provided (memory care significantly increases rates), claims history, and coverage limits. A small 6-bed RCFE might pay $5,000–$12,000/year for a complete program. Larger facilities with memory care units pay significantly more.
